WHAT IS SPECIFIC TO VIRGINIA

Virginia facts that touch this loan

  • Foreclosure. Virginia is listed as a non-judicial-foreclosure jurisdiction: a power-of-sale clause in the deed of trust or mortgage lets the sale proceed without a court judgment, following the statutory notice steps. §55.1-321 requires notices before trustee sale and references advertising under §55.1-322: a statutory nonjudicial deed-of-trust sale process, with distinct owner-occupied residential provisions. [1][7]
  • State deed taxes. Virginia’s state deed recordation tax is $0.25 per $100 or fraction of the greater of consideration or actual value (§ 58.1-801). The separate grantor tax is $0.50 per $500 or fraction, excluding remaining liens (§ 58.1-802); the grantor owes that tax but may arrange for the grantee to pay. Local and regional additions are separate. [2][3]
  • County reassessment cycle. § 58.1-3252 generally requires county reassessment every four years, while permitting other specified cycles and authorized annual or biennial methods. Check the property’s local reassessment schedule rather than assuming a sale alone resets it. [4]
  • Foreign LLC registration and passive ownership. A foreign LLC registers before transacting business (§ 13.1-1051); the SCC lists a $100 registration fee. § 13.1-1059 excludes owning property without more, but an operating rental business should not automatically be treated as passive ownership. [5][6]
  • Registered settlement agents. Virginia permits attorney settlement agents and registered title-insurance agents or companies under its settlement-agent framework. It is not an attorney-only closing jurisdiction; nonlawyer authority does not include giving legal advice. [8]
  • Arlington County (Washington metro). In Arlington County, within the Washington metro, accessory homestays require an annual permit and must be in the applicant’s primary residence, occupied at least 185 days a year. The rule applies to Arlington County, not every Northern Virginia locality. [9]
  • Residential nonpayment notice as of October 19, 2026. As of October 19, 2026, §55.1-1245(F), effective until July 1, 2027, requires 14 days after written nonpayment notice before residential lease termination. Fairfax County confirms this replaced the five-day notice on July 1, 2026. Separate nonresidential rules apply. [10][11]

FAQ

Ground-up in Virginia: questions investors ask

Does Silt make ground-up loans in Virginia?

Yes. Virginia is one of the states Silt lends in, and the ground-up program covers single-family and 2–4 unit residential construction — infill, multi-lot, spec, custom and luxury.

Is Virginia a judicial or non-judicial foreclosure state?

Virginia is listed as a non-judicial-foreclosure jurisdiction: a power-of-sale clause in the deed of trust or mortgage lets the sale proceed without a court judgment, following the statutory notice steps. §55.1-321 requires notices before trustee sale and references advertising under §55.1-322: a statutory nonjudicial deed-of-trust sale process, with distinct owner-occupied residential provisions.

Do ground-up terms change in Virginia?

No. The program terms are the same in every state Silt lends in: loan amounts $200K – $10M; residential scope 1–4 units · nationwide; leverage 90% LTC · 70% ARV; structure Interest-only, 12–24 mo; draws Funded in 48h, app-based; projects Infill & multi-lot. Can I close in an LLC in Virginia?

Every Silt loan closes in an LLC or corporation, never a personal name. A foreign LLC registers before transacting business (§ 13.1-1051); the SCC lists a $100 registration fee. § 13.1-1059 excludes owning property without more, but an operating rental business should not automatically be treated as passive ownership.

What closing taxes should I budget in Virginia?

Virginia’s state deed recordation tax is $0.25 per $100 or fraction of the greater of consideration or actual value (§ 58.1-801). The separate grantor tax is $0.50 per $500 or fraction, excluding remaining liens (§ 58.1-802); the grantor owes that tax but may arrange for the grantee to pay. Local and regional additions are separate.

What do you need from the general contractor?

A licensed GC, contractor license and insurance, an executed GC agreement and an itemized budget. Plans, permits and the construction schedule should describe the same scope so underwriting and the draw plan stay aligned.
