WHAT IS SPECIFIC TO ARIZONA
Arizona facts that touch this loan
Foreclosure. Arizona is listed as a non-judicial-foreclosure jurisdiction: a power-of-sale clause in the deed of trust or mortgage lets the sale proceed without a court judgment, following the statutory notice steps. A.R.S. §33-807 authorizes nonjudicial trustee sales after default; the beneficiary may instead foreclose judicially as a mortgage. Power of sale cannot be exercised before the 91st day after recording notice. [1][2]
Statutory transfer fee. A.R.S. § 11-1132 requires a $2 fee before recording a deed or contract transferring real estate, included in the recording charge under § 11-475(A). This is a fixed statutory transfer fee, not a percentage-of-price tax. [3]
Licensed escrow channel. Arizona DIFI publishes filed rates for licensed real-property escrow agents. This documents a regulated escrow closing channel, rather than an attorney-only requirement. [4]
Foreign LLC registration and passive ownership. A foreign LLC registers before transacting business; the regular Arizona Corporation Commission filing fee is $150. A.R.S. § 29-3905 exempts owning property without more, which should not automatically be extended to an operating rental business. [5][6][7]
Residential nonpayment. A.R.S. § 33-1368(B) permits termination of a residential tenancy if rent remains unpaid five days after written notice of nonpayment and intent to terminate. This residential rule is not a commercial-lease notice period. [8]
Phoenix permit application. Phoenix requires a short-term rental permit under City Code § 10-197, with a transaction privilege tax license, qualifying liability coverage and county rental registration evidence. Phoenix city limits—not the whole metro—define where this permit rule applies. [9]
LPV Rule A and Rule B—not a purchase-price rule. Maricopa County’s limited-property-value Rule A generally increases prior LPV by 5%, capped at full cash value. Rule B applies to specified omitted property, use changes, major construction or destruction and parcel changes; changing a single-family occupant or classification alone is not a use change. This is not a blanket sale-price-reset rule. [10]

Is Arizona a judicial or non-judicial foreclosure state?
Arizona is listed as a non-judicial-foreclosure jurisdiction: a power-of-sale clause in the deed of trust or mortgage lets the sale proceed without a court judgment, following the statutory notice steps. Can I close in an LLC in Arizona?
Every Silt loan closes in an LLC or corporation, never a personal name. A foreign LLC registers before transacting business; the regular Arizona Corporation Commission filing fee is $150. What closing taxes should I budget in Arizona?
A.R.S. § 11-1132 requires a $2 fee before recording a deed or contract transferring real estate, included in the recording charge under § 11-475(A). This is a fixed statutory transfer fee, not a percentage-of-price tax.
What do you need from the general contractor?
A licensed GC, contractor license and insurance, an executed GC agreement and an itemized budget. Plans, permits and the construction schedule should describe the same scope so underwriting and the draw plan stay aligned.
