WHAT IS SPECIFIC TO OHIO
Ohio facts that touch this loan
Foreclosure. Ohio is listed as a judicial-foreclosure jurisdiction: the lender files in court and a judgment precedes the sale. Court calendars, not the deed of trust, set the pace, so distressed-asset timelines in Ohio run longer than in power-of-sale states. ORC 2323.07 requires the court with jurisdiction to order sale on mortgage foreclosure. [1][2]
County transfer tax. ORC 322.02 allows a county deed transfer tax of up to $0.30 per $100 or fraction and charges it to the grantor. This is the optional county component, not the entire conveyance charge. [3]
Sale-price evidence. ORC 5713.03 permits the county auditor to consider a recent arm’s-length sale price as true value for taxation. It does not require every sale to trigger an automatic purchase-price reset. [4]
Title settlement protection. ORC 3953.32 requires an offer of closing or settlement protection when a title policy is ordered, covering specified title-agent misconduct and failures to follow agreed instructions. This protection is distinct from legal advice. [5]
Passive ownership exception. ORC 1706.512 excludes owning real or personal property from transacting business. Ask counsel whether the proposed rental operations involve activities beyond that ownership exception. [6]
Nonpayment possession notice. ORC 1923.04 generally requires a notice to leave at least three days before filing a possession action. Residential notices must include the statutory warning; this is a notice to leave, not a statutory three-day cure right. [7]
Columbus STR permit. Columbus requires an STR permit for rentals of all or part of a home for fewer than 30 nights and identifies Chapter 598 as its short-term rental code. Columbus city requirements do not extend automatically to neighboring municipalities. [8]
Foreign LLC registration filing fee. Ohio SOS Form 617, Registration of a Foreign Limited Liability Company, states a $99 filing fee. Optional expedited-service charges are additional, not part of the base filing fee. [9]
